In the matter of the November allow ance of Godfrey Shmale, a county charge, it is ordered that his allowance be drawn in two warrants, one in favor of Godfrey Shmale for $2, and one in fa-. vor Hans bchwantzen for $1, , In the matter of the application of Mrs. Volchersfor aid. In the ra.itter of the report of J. T. Drake, Gilbert Rob bius and Bud Thompson, viewers ap pointed at the last tenn of the board to view and locate a county road situated in Clackamas county, Oregon, and de scribed in full on page 23" of this jour nal. Said viewers filed their report showing that they had nM on the 21st day of October, 1901, a day named in the notice served upon the n and were duly sworn by subscribing to a written oath of office administered by John W. ivfeldrum, deputy countv etirevor, he being appointed by the boar 1 to survey said road, after which tli'-y proceeded to the designated place and did view and cause to be surveyed by paid- deputy county surveyor, the abivo described road . They also filed the field no es and plat of uurvev. Said viewers report favor ably to tha establishing of said road as viewed ,.nu surveyed for the reasonsthat it is a good, practical route and of prac tical utility. And it appearing to the board that there is no remonstrance or petition for damages filed, and being sat isfied that said road will be of public utility, it is ordered and adjudged that the field notes and plat of said survey be recorded and in all respects approved, and that the said view and survey be established as a county road and that the expense of said view and survey be paid by Clackamas county, and the clerk is hereby ordered to issue the nec essary notice to the supervisor of the district or districts in which said road lies to open and work the same. Tinsley for aid. It is ordered that this matter be laid over, and that W. T. Tinsley be examined by the county physician before any aid be granted. In the matter of the petition of 'II. E Oross for settlement of taxes on tract J, Clackamas Fruit Lands for the year 1898 and 1899, on the payment of the taxes as shown on the assessment roll and six per cent interest on the assessment roll and six per cent interest on the assess ment to date of payment. In the matter of the petition of E. II. Cooper for authority to withdraw money from county treasurer. This matter now coming on to be beard on petition of E. H. Cooper ehowing to the board that on the 18th day of October, 190 1, tax certificate No. 974 for the year 1898, assignedto E. F. Riley and tax certifi cate No. 99 for the year 1899 assigned to E. 8. Collins, were redeemed for the amount of $5.07, and $14 46 respectively, making a total oj $19.53. mat said money by mistake vas turned over to the county treasurer, when it belonged to the parties to whom the certificate had been assigned. E Stone, and more than 12 householders of the county, Hy ing in the vicinity of ihe road described in the petition, and praying viewers to be appointed to view and locate a county road in Clackamas county, Oregon, de cribed in full as follows: Commencing at the northeast corner of section 2 township 1 south, range 3 east, the same being in the center of the township lirre road and in the county line between Multnomah and Clackamas counties; thence running three-fourths miie west on said line, said road to be 30 feet wide and on the south sir'e of said line and to be a joint road with Multnomah county. Said petitioner filed his affi davit of notices posted respecting said road, showinz that there had been posted, one on the court house bulletin board and three in three 'of the most public places in th6 vicinity of the pro posed road more than ol) days prior to the presentation of this petition. He also filed a bond of one hundred dollars, conditioned according to law. It appear ing to the board that this is to be a joint road with Multnomah county to view and survey said road and that a date has btn set therefor, it is the.efore or dered that said surveyor and viewers be and are hereby empowered by Clacka mas county to view and locate said road on the part of Clackamas county and re port in writing at the next regular terra of the board. In the matte of the petition of E . M. Howell for ubate of money paid for property at tax sale of 1899. This matter hot coming on to be heard on petition of E. M. Howell filed herein, showing to the board that at the tax sale for delinquent taxes for the year 1899 held on the3rd day of November, 190J, he bought lots 2 and 7, block 26, all of block 3i ; lots 1 to 6, block 37 and all of block 37, Caneraah; that on investiga tion he finds that the said property was also assessed in acreage for the same year, and that said assessment in lots and blocks constituted a double assess ment. And the boaid being fully ad vised, it is ordered that E. M. Howell have a rebate in the sum of $31.94, being the amount paid for said lots and blocks at said sal, Total $19 53 In the matter of deed of O. U. Bailow and wife to the road at new bridge, near Canby. It iB ordered that said deed be and hereby is in all respects approved, and that the same be recorded'. In the matter of the collection of sub scription for the improvement of the Lo gan and Hatchery road. Said report shows collection of $9o in cash siuce last report. In the mutter of the petition -of H. Had Perry for "rebate of taxes on Clacka mas Prune Lands. This matter coming on to be heard on the petition of 11. Had Perry asking for a rebate of $1.44 on taxes of 1900 on lot 36, Pruneland, for the rea.son that said lot was un equally assessed, and the board being tuiiy advised, it ia ordered that said pe tition be denied. In the ni tier of the application of Gordon E Hives for rebate of filing fees. Now comes Gordon E. Hayes and shows to the board that he paid $10 filing fees in suits .of State Land Board against Addie C. Hodgkin, et al, and W. ii. Jennings et al ; that said fees are unnecessary and not required by law, and the board being fully advised, it is ordered that Gordon E. Hayes have a re bate in tne sum of $10, and that tne clerk draw a warrant for same. In the matter of the claim of James Peterson for damages on public high way of Clackamas county. It is ordered that the claim by and hereby is in all respects denied. In the matter of the'application of W. H. Mattoon for aid of O. S. Phelps and wife. It is ordered that a warrant for $5 be drawn in favor of W, II . Mattoon for aid of O. S. Phelps and wife. bills are for work bridge at Butte tract for said work Marion county. It was ordered that the clerk send the bills to Marion county for payment. In the matter of the indigent soldiers' fund. Ir .is ordered that the county treasurer transfer $100 from the general fund into the indigent soldiers' fund.' In the matter of report of officers for month of October, 1901. The officers having made their reports and the board having examined their books, and being fully advised, it is ordered that the same be and hereby is in all respects approved and accepted, and reports show collections as follows, to-wit. Cheney, showing to the board that at the recent sale of tax liens he purchased the old "Sinter Mill" property ; that said pur chase was lor taxes ol 1S97, and that the description of said property in Baid as sessment lor said year was not correct. He therefore asks the board in consider ation of paying the taxes on said prop erty for the years 1898, 1899 and 1900, to assign to bni the certificate of Sfle for the year 1898, wherein the description iscoirect. And the board being fully advised, it it is ordered that said appli cation be denied. In the matter of rebate of poll tax of Otto Heiser. Now comes on to be heard the petition of J. J. Cooke Bhowing to the board that for the year, 1900, Otto Heiser was assessed with a poll tax of $3, the same being paid by J. R. Mor ton, and that the said Otto Heiser was an invalid and not liable for poll lax. And the board being fully advised, it is ordered that a warrant be drawn in fa vor of J.
